1. Scope
These general terms and conditions apply to the use and participation in the Dunhill Loyalty Program. By registering on the Dunhill Loyalty Program, you agree to these general terms and conditions. We reserve the right to modify these general terms and conditions at any time. The general terms and conditions are those active at the time when you access and use the website. It is therefore your responsibility to consult the terms and conditions regularly.
Employees of British American Tobacco Switzerland SA (‘BAT’), and their families, BAT service providers, employees of BAT Vending, and employees of any other companies affiliated with the BAT Group in Switzerland and throughout the world may not take part in the Dunhill Loyalty Program.
If there are differences between the German, English and French versions of the general terms and conditions, the French version will supersede.
2. Access and conditions for participation
Participation in the Dunhill Loyalty Program is free of charge and is not associated with any purchase obligation.
The Dunhill Loyalty Program is intended only for smokers who have reached the age of at least 18 years and are resident in Switzerland. To obtain access to this site, you must be able to prove your identity, age and place of residence. Only access from Switzerland is permitted. You must also register and choose a username and password to be used solely for your personal use. This information must not be disclosed to third parties. As a user of this website, you are required to take the necessary steps to keep your username and password secret. You must inform us immediately if you have reason to believe (i) that someone knows your password or username, or (ii) that there is a risk that your username and password have been used without authorisation.
We reserve the right to cancel your registration and therefore close your user account at any time without notice if you fail to comply with the obligations laid down in these general terms and conditions.
For each qualified purchase you may receive points. Different levels of memberships are available and are subject to the points collected through the Dunhill Loyalty Program. The requirements for qualified purchases are stated in the Dunhill Loyalty Program and may change from time to time. BAT reserves the right to change, adjust or modify the membership levels and the amount of points you may receive for each qualified purchase without prior notice.
3. Rewards and Vouchers
The rewards and vouchers available and the necessary points to win the rewards are stated in the Dunhill Loyalty Program. BAT reserves the right to change, adjust or modify the rewards and vouchers and the necessary points to win.
Rewards may include vouchers from third parties; there is no partnership between BAT and such third parties. Terms and conditions of the third party may apply to redeem the vouchers. BAT does not assume any liability or provide any guarantee with respect to the vouchers.
Rewards cannot be exchanged or paid out in cash. Rewards are personal and cannot be given to third parties.
BAT reserves the right to adjust, extend, shorten the available rewards and vouchers at any time and without notice.
BAT reserves the right to terminate the Dunhill Loyalty Program at any time at its sole discretion. No claim for compensation of any kind can be derived from the discontinuation of the competition. No claims or benefits arise. Furthermore, BAT rejects any responsibility in the event that the data collected in participants’ questionnaires or emails is not recognised by the system, or in general in the event that technical errors or other reasons prevent participation in the Dunhill Loyalty Program.
BAT also reserves the right to exclude participants from the Dunhill Loyalty Program and cancelling any accounts; this applies in particular to cheating or attempts to do so (for example, creation of false participant accounts), manipulation of or attempt to manipulate the rules, or violation of these conditions of participation.
4. No guarantees
BAT will not assume any liability or provide any guarantee (i) as to the satisfactory operation of the Dunhill Loyalty Program and/or applications, (ii) as to the possibility of accessing and using such Dunhill Loyalty Program and/or applications, (iii) as to the complete, accurate and current nature of the content, information or data shown on the Dunhill Loyalty Program and/or applications, (iv) as to the absence of any defects in the Dunhill Loyalty Program and/or applications, or their content, and in particular as to the absence of viruses or other malware, and (v) concerning the absence of specific qualities that could be expected in relation to the Dunhill Loyalty Program and/or applications, or their content.
If a consumer accesses the Dunhill Loyalty Program and/or applications, uses them or downloads content from them, that individual does so voluntarily and subject to their own risk.
5. Intellectual property rights
Use of the Dunhill Loyalty Program and/or applications does not mean that you have license rights concerning the intellectual property rights relating to the content of the website.
The Dunhill Loyalty Program, the applications and all of its content (in particular software, files, designs, graphics and data) are the property of British American Tobacco Switzerland SA and are protected by the laws governing intellectual property, including copyrights, and by the law governing protection of brand names and trademarks. Any unauthorised use of this website, and in particular (i) use of this website or its content for any professional or commercial purposes whatsoever, and (ii) the reproduction, representation, sharing, disclosure, circulation, dissemination, modification or awarding of a licence, or any other use in any manner whatsoever of this website, its content, text, sections of a text or still or animated images, audio data, software, products or services, and any other data or information is expressly prohibited without prior written consent from BAT. Framing and in-line linking of the content of the website, in particular, are prohibited.

8. Safeguard clause

9. Applicable law and jurisdiction
These terms and conditions are governed by and interpreted in accordance with Swiss law under exclusion of its conflict of laws provisions. The competent jurisdiction is the place of residence of the customer, which must be located in Switzerland.
